These Terms of Use ("Terms") are an agreement between you and Stoked Bear LLC ("we," "us," "Stoked Bear"), the operator of the Alpheus iOS application and related services ("Alpheus" or the "Service"). By downloading, installing, or using Alpheus, you agree to these Terms and to the Community Guidelines. If you do not agree, do not use the Service.
You must be at least 13 years old to use Alpheus. If you are between 13 and the age of majority in your jurisdiction, you may only use Alpheus with the permission of a parent or legal guardian.
You access Alpheus by signing in with Sign in with Apple. You are responsible for all activity that occurs under your account. Notify us at support@stokedbear.com if you believe your account has been used without your authorization.
You retain ownership of the content you create, post, or upload to the Service (including chat messages, photos, and run data). By posting content in a Circle, you grant Stoked Bear a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely for the purpose of operating and improving the Service. This license ends when you delete the content, except where retention is required for our legal obligations or to enforce these Terms or the Community Guidelines.
You agree not to use the Service to engage in conduct that violates the Community Guidelines, breaks the law, infringes the rights of others, attempts to gain unauthorized access to our systems, or interferes with the operation of the Service for other users.
Alpheus may be offered as a free download with optional in-app purchases or subscriptions ("Paid Features"). All Paid Features are sold through Apple's App Store and are subject to Apple's standard terms. Subscription billing, renewal, cancellation, and refunds are managed by Apple through your Apple ID account.
The Service is provided "as is" and "as available." We do not guarantee uninterrupted, error-free, or always-current service, and we may modify or discontinue features at any time. Health and fitness information presented in the Service is for general informational purposes only and is not medical advice. Consult a qualified medical professional before beginning any new training plan or making changes to your exercise routine.
You may stop using the Service and delete your account at any time from Settings → Privacy → Delete Account. We may suspend or terminate your account if you violate these Terms or the Community Guidelines, with or without notice. Upon termination, the licenses you granted us in your content will end, subject to the limited retention period described in the Privacy Policy.
To the maximum extent permitted by law, Stoked Bear disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the Service is at your own risk.
To the maximum extent permitted by law, Stoked Bear and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Service. Our total liability for any claims arising from the Service is limited to the greater of $100 USD or the amount you have paid to us in the 12 months preceding the claim.
You agree to defend and indemnify Stoked Bear from any third-party claim arising from your content, your use of the Service in violation of these Terms, or your violation of any applicable law.
These Terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict of law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Greenville County, South Carolina, and you consent to the exclusive jurisdiction of those courts.
We may update these Terms from time to time. Material changes will be announced in the app at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
